Class Action Lawsuit To Proceed Because Of A Picture Of Mice Snoozing Beside A Repeller

In New York, a judge allowed a class action lawsuit to proceed against a company that sells and markets anti-rodent devices. US District Judge William Pauley III cited three pictures of mice lounging around the anti-rodent device. In one of the pictures, it can be seen that a mice is sitting on top of the device. Judge Pauley also noted that the lawyers submitted more than 42,000 words in an effort to convince him how to rule. However, the photographs were worth more. The lawsuit was filed in 2015 by a group of women from Palm Desert, California and Woodville, Texas. They represented others who purchased 2.4 million Bell + Howell Ultrasonic Pest Repellers based on the advertisement that the device was effective in repelling mice, rats, roaches, spiders and ants. It was concluded that the devices which have to be plugged into an electrical outlet are ineffective.

Meanwhile, the packaging has a disclaimer that says ultrasonic signals may lose their intensity during travel and can be absorbed by soft items like carpets. Signals can also be reflected on hard surfaces like furniture.
